Section 154 Crpc Says In Cognizable Case Police Should Have To Register Fir

Section 154 Crpc-Every Information Relating To The Commission Of Cognizable Offence ,If Given Orally to an Officer in charge a police station, shall be reduced to writing by him or under his direction and be read over to the informant;and every such information whether given in writing or reduced to writing as aforesaid  Shall be signed by the person giving it and the substance thereof shall be entered in a book to be kept by such officer in such form as the state government may prescribe in this behalf

साधारण भाषा में-संज्ञेय  अपराध के होने के बारे में  प्रत्येक  जानकारी /शिकायत  चाहे वह  लिखित में  दी गई  हो या मौखिक थाने के प्रभारी को उसे लेखबद्ध करना होगा और   लेखबद्ध की गई शिकायत को शिकायतकर्ता द्वारा 

हस्ताक्षरित करवाया जाएगा, और शिकायत का शारांश राज्य सरकार द्वारा विहित पुस्तिका में दर्ज किया जाएगा

1.Application direct/Application by post to Superintendent  Of Police A/s 154 (3)- Aggrieved by Refusal to Register Fir By Police Can Sent Application By Post Or Direct To Superintendent of Police

2.Complainant To Judicial Magistrate U/s 200 Crpc-If even after submitting a complaint to Senior Police officials no FIR is lodged then the informant is legally entitled to file a complaint to the Judicial Magistrate/ Metropolitan Magistrate u/s 156(3) read with Section 190 of the criminal procedure thereby requesting the FIR to be registered by the police and commencing investigation into the matter.

3.Petition U/s 482 Crpc Inherent Power Of The High Court- There Are Some Inherent Power Of the High Court under Which Court Can Grant of Relief Or Direct to Court Or Any Statutory authority to do or stop any Act which is Against public Justice and Law or To prevent abuse of the process of any court or otherwise

4.Writ Petition U/A- 226-A Writ Petition in the respective High Court may be filed for the issuance of Writ of Mandamus against the defaulting Police officers, inter alia, to Register the FIR and directing him to show cause the reasons for him not lodging a FIR.

5.Special Leave Petition Under Article 136- The Constitution of India gives power to the Supreme Court to grant special permission or leave to an aggrieved party to appeal against an order passed in any of the lower courts or tribunals in India.
